Agreement to Terms

By accessing or using CandidGO ("the App"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

Description of Service

CandidGO is a photo sharing application that allows users to:

• Share photos with automatically generated links
• Display camera settings and EXIF data
• Add optional tip links to shared photos
• Gate photos behind payment requirements

Account Registration

You may use basic photo sharing features without creating an account. To access additional features like paid links and tip links, you must sign in with your Apple ID. You are responsible for maintaining the security of your account.

User Content

Photographer Rights and Certification:

By uploading any photo to CandidGO, you certify and warrant that:

• You own all rights to the photo or have obtained all necessary permissions, licenses, and consents from the copyright holder and any individuals depicted in the photo
• You have the legal right to upload, share, and (if applicable) commercialize the photo
• You have obtained consent from all individuals who appear in the photo to have their likeness shared and commercialized (if using paid photo features)
• The photo does not infringe on any third party's intellectual property, privacy, publicity, or other rights
• You accept full responsibility for any legal claims arising from the photos you upload

Platform Role:

CandidGO is a hosting and delivery platform only. We do not review, verify, or endorse user-uploaded content. Photographers are solely responsible for ensuring they have the legal rights to upload and commercialize their photos. CandidGO is not responsible for any copyright infringement, privacy violations, or other legal issues arising from user content.

Photo Sharing:

• You retain all rights to photos you upload
• You grant CandidGO a non-exclusive, worldwide license to store, display, and deliver your photos for the purpose of providing the service
• Shared photos are publicly accessible via their unique links
• Links automatically expire after 7 days
• You can delete photos at any time within the 7-day period

Prohibited Content:

You may not upload content that:

• Violates any laws or regulations
• Infringes on intellectual property rights or privacy rights
• Contains malware or harmful code
• Is threatening, harassing, or abusive
• Contains explicit adult content without proper consent from all depicted individuals
• Depicts illegal activities
• Violates the rights of any third party

Acceptable Use

You agree not to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to the App or related systems
• Interfere with or disrupt the App's functionality
• Use automated systems to access the App without permission
• Impersonate others or provide false information

DMCA and Content Takedown Policy

Copyright Infringement (DMCA):

CandidGO respects intellectual property rights and responds promptly to claims of copyright infringement. If you believe that content on CandidGO infringes your copyright, you may submit a DMCA takedown notice.

Filing a DMCA Takedown Notice:

To report copyright infringement, send a written notice to support@candidgo.com with the following information:

• Your physical or electronic signature
• Identification of the copyrighted work claimed to have been infringed
• Identification of the material claimed to be infringing (e.g., the CandidGO photo link)
• Your contact information (address, phone number, email)
• A statement that you have a good faith belief that the use is not authorized by the copyright owner
• A statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner

Response Time:

We will investigate and respond to valid DMCA notices within 48 hours. If the claim is valid, we will remove or disable access to the infringing content immediately.

Counter-Notification:

If you believe your content was removed in error, you may file a counter-notification with the same information listed above, plus a statement under penalty of perjury that the content was removed by mistake or misidentification. We will forward your counter-notification to the original complainant and may restore the content within 10-14 business days unless we receive notice that legal action has been filed.

Repeat Infringer Policy:

Users who repeatedly upload infringing content will have their accounts terminated. We maintain a record of all DMCA takedown notices and may permanently ban users who violate copyright laws multiple times.

Privacy and Publicity Rights Violations:

If you believe a photo violates your privacy rights, publicity rights, or depicts you without your consent, please contact us at support@candidgo.com with:

• The photo link (e.g., candidgo.com/ABCD)
• Your name and contact information
• Proof of identity (to verify you are the person depicted)
• Description of the privacy violation

We will review and respond to privacy complaints within 48 hours. Valid complaints will result in immediate content removal.

General Content Reports:

To report content that violates these Terms of Use (prohibited content, illegal activity, etc.), contact us at support@candidgo.com with the photo link and a description of the violation. We review all reports and remove content that violates our terms.

Payment Processing

Paid Photos (Photo Unlock Payments):

When using the paid photo feature, payments are processed through Stripe Connect. Photographers must create a Stripe Connect account to receive payments. By using paid photo features, you agree to:

• Stripe's Connected Account Agreement
• Stripe's Services Agreement
• Stripe's Privacy Policy

Photographers are responsible for their own tax reporting and compliance in their jurisdiction.

CandidGO does not store credit card information. All payment processing is handled securely by Stripe.

Intellectual Property

The App, including its design, code, and branding, is owned by CandidGO and protected by copyright and other intellectual property laws. You may not copy, modify, or reverse engineer any part of the App.

Privacy

Your use of the App is also governed by our Privacy Policy. Please review it to understand how we collect and use your information.

Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CANDIDGO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP.

CandidGO is not responsible for user-generated content. We are a hosting platform and do not review, approve, or endorse photos uploaded by users. Any disputes regarding photo rights, consent, or legality are solely between the photographer and affected parties.

Indemnification

You agree to indemnify, defend, and hold harmless CandidGO, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms of Use
• Your violation of any third party rights, including copyright, privacy, or publicity rights
• Any photos you upload to the platform
• Any claims that your photos infringe on intellectual property or violate laws
• Your use of paid photo features without proper consent from depicted individuals

This indemnification obligation will survive termination of your account and these Terms of Use.

Changes to Terms

We may update these Terms of Use from time to time. Continued use of the App after changes constitutes acceptance of the updated terms. We will notify users of material changes through the App or via email.

Termination

We reserve the right to suspend or terminate your access to the App at any time for violation of these terms or for any other reason. You may also delete your account at any time by contacting support.

Governing Law

These Terms of Use are governed by the laws of England and Wales. Nothing in these terms affects your statutory rights as a consumer in your country of residence.
